Is Bankruptcy The Right Option For You?

Financial pressure brought about by debt can often create stress, sometimes extreme stress, for individuals and families.  This may lead you to consider whether or not filing bankruptcy may be an option for you and your family.

Whether or not bankruptcy is an option for you, or the best option for you and your family, is a critically important question that Kinkade & Associates has been working with clients for over twenty years to answer.  Our experience, dedication, knowledge and high level of customer service provide us with a high level of confidence that we can work with you to develop the proper debt relief strategy.  Debt relief is all we do.

To answer this critically important question one of our caring, knowledgeable and experienced attorneys will conduct an in-depth conversation with you either in person or by phone in a no-charge strategy session.  During your no-charge strategy session we will learn the circumstances and the details of your situation.  We will not make any recommendation to you without learning all of your facts and circumstances and thoroughly discussing with you the details of your debt relief options.

Some of the factors we believe may be worth considering as we evaluate your circumstances can be summarized briefly below:

1.    Are you experiencing Creditor Pressure?

Creditors can bring tremendous pressure with various debt collection activities including harassing phone calls, attempted repossession of collateral, court filings, wage garnishments, freezing bank accounts as well as possible foreclosure of real estate.  The greater the pressure the greater the potential disruption of your financial well being and your life otherwise.  Filing bankruptcy triggers an “Automatic Stay” on creditor collection efforts and can help relieve this pressure.  Depending on the type of debt and the type of bankruptcy filed, the Automatic Stay will protect you until the bankruptcy process concludes with a discharge of the debt or at least a pause in collection efforts with respect to secured debt (vehicles with liens, real estate with a mortgage, some types of tax debt as well as some types of consumer loans with collateral attached).

2.    Would you benefit from the elimination of unsecured debt through discharge?

Unsecured debt, most commonly credit card debt, personal loans, medical bills, deficiency balances on repossessed collateral, debts related to evictions, and pay day loans, will typically be discharged at the successful conclusion of a bankruptcy.  A discharge in bankruptcy renders dischargeable debt legally uncollectible.  When unsecured debt becomes overwhelming and creditor collection efforts threaten to disrupt and sometimes devastate your financial life, the benefits of a discharge in bankruptcy can not only permanently relieve the pressure of creditor collection efforts but also provide the opportunity to rebuild your financial life after a bankruptcy discharge.

3.    Is there a potential opportunity for you to reorganize and repay debt?

Pressure can also exist with secured debt, such as loans on vehicles, homes and sometimes other types of debt secured by collateral.  Payments on secured debt may become unaffordable due to a change in life circumstances.  Bankruptcy may provide an opportunity to either eliminate the debt through surrender of the collateral, or a provide a potential reorganization of the debt through a Chapter 13 plan of reorganization. Chapter 13 can stop foreclosure and permit you to propose a plan to make up missed mortgage payments over time.  Chapter 13 can also permit you to stop threatened repossession of collateral such as vehicles with a lender lien and catch up the payments on that vehicle.  A Chapter 13 plan of reorganization can assist you in paying for collateral you want to keep and end creditor collection efforts while you make payments.

4.    Which type of bankruptcy or other debt relief is right for you?

By the end of your no-charge strategy session we will have learned the details of your current circumstances and be in a good position to discuss your options for debt relief. The type of bankruptcy you can file, or should consider filing, Chapter 7 or Chapter 13 (for a thorough discussion of each, please see additional information on our web site), will be thoroughly discussed with you and your questions regarding each answered to the best of our ability.
We feel that you are entitled to as much information as we can provide to put you in the best position to make a decision regarding your debt relief options and the best timing for a potential bankruptcy filing.
